1. BOOKING TERMS & CONDITIONS

A booking between the owners and the person making the booking -  ‘the client’ (who must be over 21) shall be deemed to be valid only on completion, including signing, of the booking form and receipt of the agreed payment.  Signing constitutes  the acceptance of the Booking and Payment Procedure/Terms and Conditions by the client and shall be a warranty by the person so signing that they have the authority to act on behalf of the persons named on the booking form including any substitutions or additions by any subsequent agreed amendments to the booking.  The booking is valid when written confirmation has been received by ‘the client’ from the owner.

The procedure and conditions will still apply even if for any reason the booking form has not been completed by the client e.g. in the case of a late
booking requested by telephone which necessitates an immediate commitment.

If ‘the client’ does not pay the final balance of the rental charge, together with the security deposit, at the prescribed time,

The accommodation cannot be shared, assigned and only the persons shown on the booking form are permitted to stay in the property. Persons under the
age of 21 years are not acceptable unless accompanied by parents or an adult.

No pets are permitted in the property and no smoking is allowed in the villa.

2. PAYMENT

Deposits and Payment are to be made in accordance with the Booking & Payment Procedure. Payment falls due at the following stages:

At time of Booking – Deposit, equivalent to £100/$150 for each week of the rental period.

10 Weeks prior to arrival date – Remaining rental fee in full plus security bond (see section 5)

Failure to comply with the payment procedure will be deemed to be a cancellation by ‘the client’ and the owners reserve the right, upon such cancellation of the booking, to forfeit the deposit and recover from ‘the client’ all sums then due (as detailed in section 6)

3. THE RENTAL PERIOD

The villa is available for occupation from 4:00 pm (local time) on the day of arrival until 10:00 am (local time) on the day of departure. Late checkout may be allowed if the villa is not occupied the same or next day and agreement has been made with the management company and the owner.

4. PRICE GUARANTEE

The rental price for the villa is fully guaranteed when the deposit
has been paid & cashed and the booking acknowledgement/receipt has been issued.

5. THE SECURITY BOND

The client is solely responsible for any damages or breakages that may be caused to the property or to its contents and also for any loss of items in the inventory during their stay. Therefore a £200/$300 refundable security/breakage deposit payable with the final balance will be held against such an eventuality. This is to cover excessive and extreme use of electricity (e.g. Air Conditioning on full, with external doors open), excessive cleaning costs, and/or any damage, breakage/loss to the Villa and
contents.

The villa is inspected before and at the end of each occupation.

Since it is not possible to check the accommodation before departure, the security bond will be reimbursed as soon as possible after return.
In the event of any damage/loss, which is assessed to be in excess of the Security Bond, the client will be held responsible for full reimbursement of the outstanding amount within 28 days.

It is important that the property be left clean and tidy at the end of the rental period, including the BBQ facilities.

6. CANCELLATION BY CLIENT

Any cancellation by the client must be notified in writing directly to Mr B Applin. In the event of cancellation by the client, the following charges will apply:

It is the clients own responsibility to have adequate holiday insurance to cover personal injury/damage/accidents.

No claim whatsoever will be accepted by the owners of the property.  Please ensure you have travel insurance to cover you for cancellation as well as medical cover as the costs in USA are extremely high.

7. CANCELLATION BY THE OWNERS

In the unlikely event that circumstances beyond the reasonable control of the owners necessitate the cancellation of the booking, the owners reserve the right to cancel the booking, at any time, and shall only be liable to refund the monies already paid by client , (without interest, compensation or consequential loss of any kind).

8. COMPLAINTS

All problems, in the first instance, should be referred to the local management company.

9. LIMITATION OF LIABILITY

We accept no liability to pay compensation in respect of any damage, loss or changes arising from unforeseeable circumstance beyond our control, including but not limited to hurricanes, floods, major events etc.

POOL - Guests are specifically advised not to allow unsupervised children to use the pool. Clients may use the pool facilities at their own risk. Safety signs are displayed. GLASS is not permitted in the pool area. During extreme cold weather spells, the owners cannot guarantee the pool will reach a comfortable temperature. In this event the owners regret no refund will be made for prepaid pool heating.
